The Contest
begins on August 15, 2009, 11:00 AM (PDT) and ends on August 21, 2009
at 11:59 PM (PDT) and consists of nine (9) daily trivia contests. The
Trivia Question of the Day (defined below) will be posted at 11:00am
(PDT) each day of the Contest period as further described in Section
3 below.
The Luxor Trivia
of the Day Contest (the “Contest”) is open to legal
residents of the U.S., fourteen (14) or older, as of the date of entry,
who have Internet access, an active Twitter account and who have subscribed
as a “Follower” to the LUXOR iPhone Twitter page administered by
MumboJumbo (located at http://twitter.com/luxoriphone
Employees of the
Sponsor and their respective parent companies, affiliates, subsidiaries,
advertising, promotion, fulfillment or other coordinating agencies,
individuals providing services to the Sponsor through an outsourcer
or temporary employment agency during the Contest period, and their
respective immediate family members and persons living in their same
household, are not eligible to participate in the Contest. Participation
in the Contest constitutes entrant’s full and unconditional agreement
to and acceptance of these Official Contest Rules (“Official
Rules”). VOID WHERE PROHIBITED.
To enter the Contest
you must: (i) subscribe to the Luxor Twitter Page as a “Follower”;
(ii) enter an answer to the daily trivia question posted by the
Luxor Twitter Page administrator (“Trivia Question of the Day”);
and (iii) “retweet” the Trivia Question of the Day when you submit
your answer.
Each day of the Contest
period at 11:00 AM (PDT), the Trivia Question of the Day will be posted
on the Luxor Twitter Page by the MumboJumbo administrator. You may enter
an answer to the Trivia Question of the Day only once during the 24
hour period for each day of the Contest period.
Each day’s Contest
entries meeting the requirements of these Official Contest Rules will
be eligible to win a prize. The first entrant to answer the Trivia
Question of the Day correctly wins a prize for that day of the Contest.
The time of entry will be clocked by Sponsors internal systems. All
determinations of Sponsor are final and binding.
An entry is only
eligible for consideration as a correct answer for the Trivia Question
of the Day on the day on which the corresponding Trivia Question of
the Day is posted. For example, if you enter a correct answer to a Trivia
Question of the Day that was posted on a prior day of the Contest period,
such entry will not be accepted. Answers sent privately via a “Direct
Message” on Twitter and/or provided in other forums (e.g., Facebook)
will also not be accepted.
No mechanically reproduced entries are allowed and any use of robotic, automatic, programmed or the like entry methods will void all such entries by such methods.
Prizes:
Seven (7) iTunes promotional codes redeemable in the U.S. Apple
App Store for the iPhone OS game “LUXOR” will be awarded.
Total value of
all prizes to be awarded: Each LUXOR game has an Approximate Retail
Value of $2.99 (USD); $20.93 (USD) total.
The odds of winning
a prize depends on the total number of eligible entries received. No
cash or other substitution of prizes is permitted, except at the sole
option of the Sponsor for a prize of equal or greater value. The Sponsor
will not replace any lost or stolen prizes. Winners are solely responsible
for all taxes and/or fees, if any, that apply to receiving prizes.
Winners will be notified
by a private Twitter message within five (5) business days of correctly
answering the Trivia Question of the Day.
Delivery of the promotional code will be made via Twitter direct message
within one (1) week of the date the LUXOR game is available for purchase
from the Apple App Store. The promo codes are not redeemable outside
of the U.S. iTunes App Store and will expire 30 days from the date of
issue.
If a selected winner
cannot be contacted, is ineligible, and/or fails to redeem a prize within
ten (10) business days of receiving notification from MumboJumbo, the
prize may be forfeited, and an alternate winner may be selected from
remaining valid, eligible entries submitted. In the event of a dispute
regarding who submitted an entry, the entry will be deemed submitted
by the authorized account holder of the Twitter account specified in
the entry. "Authorized account holder" is defined as
the person who is assigned to an e-mail address by Twitter, Inc.
The Sponsor reserves
the right, in its sole discretion, to cancel, modify or suspend the
Contest in whole or in part, in the event of fraud, technical or other
difficulties or if the integrity of the Contest are compromised, without
liability to the entrant. The Sponsor reserves the right to disqualify
any entrant or winner, as determined by the Sponsor, in their sole discretion.
The Sponsor is not responsible for (i) late, delayed, incomplete, illegible,
misdirected or undeliverable entries, responses, or other correspondence,
whether by e-mail or the Twitter service or otherwise; (ii) unauthorized
access to or alterations of entry communications; or (iii) electrical,
network, computer, hardware, software program or transmission malfunctions,
failures or difficulties. The Contest is subject to these Official Rules
and all applicable federal, state, provincial and local laws and regulations
apply. As stated above, the Contest is void where prohibited or restricted
by law.
By entering the Contest,
you further agree to release, indemnify, defend and hold Sponsor and
its parent, affiliates, subsidiaries, directors, officers, employees,
sponsors and agents, including advertising and promotion agencies, and
assigns, and any other organizations related to the Contest, harmless,
from any and all claims, injuries, damages, expenses or losses to person
or property and/or liabilities of any nature that in any way arise from
participation in this Contest or acceptance or use of a prize or parts
thereof, including, without limitation, (i) any condition caused by
events beyond Sponsor’s control that may cause the Contest to be disrupted
or corrupted; (ii) any injuries, losses, or damages (compensatory, direct,
incidental, consequential or otherwise) of any kind arising in connection
with or as a result of the prize, or acceptance, possession, or use
of the prize, or from participation in the Contest; and (iii) any printing
or typographical errors in any materials associated with the Contest.
In no event will
Sponsor or its affiliates be liable to you for any special, incidental,
exemplary, punitive or consequential damages (including loss of use,
data, business or profits) arising out of or in connection with your
participation in the CONTEST, whether such liability arises from any
claim based upon contract, warranty, tort (including negligence), strict
liability or otherwise, and whether or not Sponsor HAs been advised
of the possibility of such loss or damage. WITHOUT LIMITING THE GENERALITY
OF THE FOREGOING, SPONSOR’S AGGREGATE LIABILITY TO YOU ARISING WITH
RESPECT TO THESE OFFICIAL RULES WILL NOT EXCEED $5. Some jurisdictions
do not allow the limitation or exclusion of liability for incidental
or consequential damages, so the above limitation or exclusion may not
apply to you. These Official Contest Rules are governed
by the law of the State of Texas, excluding rules governing choice of
laws. Any action, suit or case arising out of, or in connection with,
this Contest or these Official Rules must be brought in either the state
courts located in Dallas, Texas.
Except where prohibited,
by participating in the Contest and winning any prize, winner consents
to the use of his/her name, photo and/or likeness, biographical information,
entry and statements attributed to winner (if true) for advertising
and promotional purposes, including without limitation, inclusion in
Sponsor’s newsletters, and on the game’s website located at http://www.luxoriphone.com, without additional compensation. All entries
become property of Sponsor and none will be acknowledged or returned.

“Follower” to the Plus+ Network Twitter page administered by Plus+

The giveaway event will run starting from August 14, 2009 (PDT) up until the day when the iPhone and iPod touch game LUXOR is made available for purchase on the U.S. Apple App Store.
The promo codes will be delivered to each individual via direct message on Twitter. The promo codes are not redeemable outside of the U.S. Apple App Store, expire in 30 days from date of delivery and will not be replaced if lost or stolen.

Sponsored by MumboJumbo LLC (“Sponsor” or “MumboJumbo”)
NO ENTRY FEE. VOID WHERE PROHIBITED. The Contest (defined below) begins on August 18, 2009 at 7:00 PM PDT (“Start Date”) and ends on August 28, 2009 at 11:59 PM PDT (“End Date”).
The LUXOR Challenge
Contest (the “Contest”) is open to legal residents
of the U.S., fourteen (14) or older, as of the date of entry, who have
an active e-mail account, access to MumboJumbo’s LUXOR game for the
iPhone OS (“LUXOR for iPhone
OS Game”) and are registered users of ngmoco’s Plus+ Network
(each a “Plus+ Member”) at the beginning of the Contest
period. (Visit http://plusplus.com for more information on how to become a Plus+
Member.) Entrants under the age of 18 must have permission from
their parents or legal guardians to participate. Employees of Sponsor
and its affiliates, subsidiaries, advertising, promotion, fulfillment
or other coordinating agencies, individuals providing services to Sponsors
through an outsourcer or temporary employment agency during the Contest
period, and their respective immediate family members and persons living
in their same household, are not eligible to participate in the Contest.
Participation in the Contest constitutes your full and unconditional
agreement to and acceptance of these Official Rules (“Official
Rules”). As a Plus+ Network member your use of the Plus+ Network
is governed by the ngmoco Terms of Use Agreement [http://www.ngmoco.com/terms-
To enter the Contest you must: (i) download LUXOR for the iPhone OS Game; (ii) join the Plus+ Network; and (iii) begin playing during the Contest period.
Only one entry per Plus+ Network account is permitted.
Participating in the Contest using cheats, automated software (e.g., bots) or like methods of game play is strictly prohibited. If you violate these Official Rules, Sponsor will take whatever action, in its sole discretion, it deems appropriate, including but not limited to cancellation of your Plus+ Network membership, as well as your future participation in any Plus+ Network contests, promotions or activities. In addition, Sponsor reserves the right to take appropriate legal action to recover damages, including its attorneys’ fees incurred, in making any claim or prosecuting any lawsuit.
All entries meeting the requirements of these Official Rules will be entered into the Contest. The entrant that has accrued the highest score, ranking first on the LUXOR global leaderboards hosted in the Plus+ Network as of the End Date will be the winner of the Contest.
In the event of a tie, the winning LUXOR Challenger will be the first person who obtained the highest score as determined by Plus+ Network server timestamp.
An entrant’s score will start to accrue on the Start Date. Score accrual will be tracked by Sponsor’s internal clocks and systems. Sponsor’s decisions (including but not limited to any calculation or computation by Sponsor’s systems or the results thereof) in all respects relative to the Contest are final.
The points which comprise an entrant’s score are not transferable and have no cash value. At no time may points be purchased, sold or bartered. Points from different Plus+ Network accounts may not be combined into one account. Scores from other games, or other versions of games, published by MumboJumbo or otherwise are not applicable.
The prizes to be awarded from the Contest are as follows:
Prize: One (1) bundle of MumboJumbo’s LUXOR game titles for Windows or Mac OS X operating systems (“LUXOR Game Bundle”).

The winner may choose
between either a Windows or Mac OS X operating system compatible LUXOR
Game Bundle.
Total value of all prizes to be awarded: The Windows or Mac OS X compatible LUXOR Game Bundle has an Approximate Retail Value of $60.00 (USD).
The odds of winning a prize depends on the total number of eligible entries received. No cash or other substitution of prizes is permitted, except at the sole option of Sponsor for a prize of equal or greater value. The Sponsor will not replace any lost or stolen prizes. Winners are solely responsible for all taxes and/or fees, if any, that apply to receiving prizes.
Winners will be notified by e-mail within seven-to-ten (7-10) business days of the determination of the winner, and may be required to sign and return an affidavit of eligibility and publicity/liability release within seven (7) days of notification. After delivery of the notification, the winner will need to indicate his or her operating system preference for the LUXOR Game Bundle. The relevant promotional codes will be delivered via email within not more than five-to-seven business days of Sponsor’s receipt of the winner’s preference. If a selected winner cannot be contacted, is ineligible, fails to claim a prize or to indicate his or her operating system preference and/or where applicable an affidavit of eligibility and publicity/liability release is not timely received, is incomplete or modified, the prize may be forfeited and an alternate winner selected from remaining valid, eligible entries timely submitted. In the event of a dispute regarding who entered the Contest, the game play will be deemed executed by the authorized account holder of the email address connected to the Plus+ Network account. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Contest in whole, or in part, in the event of fraud, technical or other difficulties or if the integrity of the Contest is compromised, without liability to the entrant. Great LUXOR Giveaway
In celebration of the launch of LUXOR on the iPhone and iPod touch, MumboJumbo will give away one free bundle (1) of LUXOR desktop titles (Windows or Mac OS X) (the “LUXOR Classic Collection”) to each 1,000th person among the first 5,000 persons to have registered to Plus+ for the first time from LUXOR.
The giveaway event will run starting from August 18, 2009 (PDT) up until when the 5,000th person newly registered to Plus+ from LUXOR has been recorded by Plus+ internal systems. A giveaway recipient must be over 14 years old and have provided a valid email address in his or her Plus+ registration.
Each recipient will be notified by direct message upon Plus+ login about the giveaway within 5 business days (5) of his or her Plus+ account registration. Those who do not receive any direct message within 5 business days (5) of registering for a Plus+ account from LUXOR are not recipients of the giveaway.
Each recipient must follow the instructions in the Plus+ direct message to provide his or her system requirements (Windows or Mac OS X) in order to claim the giveaway. The giveaway will be delivered via email to each recipient within five business days (5) from when the recipient has submitted his or her system requirement.

In no event will
Sponsor or its affiliates be liable to you for any special, incidental,
exemplary, punitive or consequential damages (including loss of use,
data, business or profits) arising out of or in connection with your
participation in the CONTEST, whether such liability arises from
any claim based upon contract, warranty, tort (including negligence),
strict liability or otherwise, and whether or not Sponsor HAs been advised
of the possibility of such loss or damage. WITHOUT LIMITING THE GENERALITY
OF THE FOREGOING, SPONSOR’S AGGREGATE LIABILITY TO YOU ARISING WITH
RESPECT TO THESE OFFICIAL RULES WILL NOT EXCEED $5.00. Some jurisdictions
do not allow the limitation or exclusion of liability for incidental
or consequential damages, so the above limitation or exclusion may not
apply to you. These Official Contest Rules are governed
by the law of the State of Texas, excluding rules governing choice of
laws. Any action, suit or case arising out of, or in connection with,
this Contest or these Official Rules must be brought in the state courts
located in Dallas, Texas.
Except where prohibited,
by participating in the Contest and winning any prize, winner consents
to the use of his/her name, photo and/or likeness, biographical information,
entry and statements attributed to winner (if true) for advertising
and promotional purposes, including without limitation, inclusion in
Sponsor’s newsletters, and on the game’s website located at http://www.luxoriphone.com, without additional compensation. All entries
become property of Sponsor and none will be acknowledged or returned.
